Pendahuluan

Indonesia adalah negara hukum. Hal ini disebutkan secara jelas dalam pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia yang menyebutkan bahwa, “Negara Indonesia adalah negara Hukum.” Negara hukum selalu dimaknai dengan adanya norma tertulis yang menjadi landasan bersama. Konsepsi negara hukum meniscayakan hukum tertulis sebagai panglimanya.

Tentang hukum Islam, jika ditilik dari sejarahnya, eksistensi hukum Islam di Indonesia mulai sejak masuknya Islam di nusantara. Paling tidak ada tiga teori tentang ini. Teori Gujarat (India), teori Makkah (Arab) dan teori Persia. Ketiganya terjadi jauh di masa pra kemerdekaan. Sejak masuknya Islam itu, nilainilai hukum Islam telah menjadi norma yang dianut oleh masyarakat nusantara.
